1. Acceptance of Terms

By accessing or using Merciful AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Merciful AI provides an AI-powered chat service that allows users to have conversations with an artificial intelligence. The Service is offered in two tiers:

• Free Tier: Available at no cost with daily token limits and access to Standard and Economy model tiers.
• Pro Tier: A paid subscription with higher token limits, unlimited Advanced model access, and priority response times.

The Service is provided "as is" without warranties of any kind. Token allocations, model availability, and features may change at any time.

3. Age Restrictions

Merciful AI is exclusively for users who are 13 years of age or older. By using the Service, you represent that you are at least 13 years old.

In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If we determine that a user is under 13, their account will be permanently banned and all associated data will be deleted. These bans are enforced automatically through our safety and moderation systems.

If you are a parent or guardian and believe your child under 13 has accessed the Service, please contact us at support@merciful.ai so we can take appropriate action.

4. Acceptable Use Policy

When using Merciful AI, you agree to:

• Not use the Service for any illegal or harmful purposes
• Not attempt to disrupt or compromise the Service
• Not impersonate others or provide false information
• Not share content that is offensive, illegal, or violates others' rights
• Not use automated systems to access the Service without permission
• Not attempt to circumvent safety filters, moderation systems, or content policies
• Not use the Service to generate, solicit, or distribute sexually explicit or adult content
• Not use the Service to generate content that promotes violence, self-harm, or harm to others

Our automated safety and moderation systems continuously monitor usage for violations. Violations may result in temporary access restrictions or permanent account bans, which are applied automatically and without prior notice. Users who are banned for policy violations are redirected to appropriate resources when applicable (e.g., crisis support resources for self-harm-related content).

5. Subscriptions and Billing

5.1 Free Tier

The Free tier provides access to the Service at no cost, subject to daily token limits and model tier restrictions as described on our blog. We reserve the right to modify free tier allocations at any time.

5.2 Pro Subscription

The Pro subscription is a recurring monthly subscription that automatically renews each billing period until canceled. By subscribing to Pro, you authorize us to charge your payment method on a recurring basis at the then-current subscription price.

5.3 Auto-Renewal

Your Pro subscription will automatically renew at the end of each billing period. You will be charged the applicable subscription fee at the start of each new billing period unless you cancel before the renewal date. You may cancel at any time through the Service interface.

5.4 Cancellation

You may cancel your Pro subscription at any time. Upon cancellation:

• You will retain Pro access until the end of your current billing period.
• No further charges will be made after the current period.
• After the billing period ends, your account will revert to the Free tier with corresponding token limits.

5.5 Refund Policy

Refund requests are handled on a case-by-case basis. If you believe you have been charged in error or are unsatisfied with the Service, please contact us at support@merciful.ai within 30 days of the charge. We will review your request and may issue a full or partial refund at our discretion.

5.6 Price Changes

We may change subscription prices at any time. If we increase the price of your subscription, we will notify you at least 30 days before the price change takes effect. Your continued use of the Pro subscription after a price change constitutes acceptance of the new price. You may cancel before the new price takes effect.

5.7 Payment Processing

All payments are processed securely by Stripe, Inc., our third-party payment processor. We do not store your credit card details on our servers. By subscribing, you also agree to Stripe's Terms of Service. Stripe may collect and process your payment information in accordance with their privacy policy.

6. Content

You retain ownership of content you submit to the Service. By using the Service, you grant us a license to process your content to provide the Service. AI-generated responses may be used to improve the Service.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Limitation of Liability

Merciful AI is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to direct, indirect, incidental, or consequential damages.

9. AI-Generated Content

Responses from the AI are generated automatically and may not always be accurate or appropriate. You are responsible for evaluating and verifying any information provided by the AI. Merciful AI is not a substitute for professional advice, therapy, or human connection. The AI's responses should not be considered professional, medical, legal, or financial advice.

10. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms of Service at any time. If we make material changes, particularly those affecting billing or subscription terms, we will notify registered users via email.

In the event that we discontinue the Service, active Pro subscribers will receive a prorated refund for the unused portion of their current billing period.

11. Account Termination

We reserve the right to terminate or suspend your access to the Service at any time for any reason, including violation of these Terms. If your account is terminated for reasons other than a Terms of Service violation, any active Pro subscription will be canceled and you will receive a prorated refund.

12. Marketing Communications

If you opt in to marketing communications during registration, you may receive occasional emails about new features, updates, and promotions. You may unsubscribe from marketing communications at any time via the unsubscribe link in any marketing email, or by updating your preferences in your account settings. Transactional emails (password resets, billing notifications, etc.) are not affected by your marketing preferences.

13. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the Service is operated, without regard to conflict of law principles.
